7able Limited – Competition Entry.
- Qualifying Persons: Our Competitions - skill based games resulting in the allocation of prizes - (the ‘Competition(s)’) are open to all persons aged 16 and over except 7able's (the 'Promoter') employees or members of their immediate family, agents or any other person who is connected with the creation or administration of our Competitions.
- Legal Undertaking: By entering a Competition the entrant will be deemed to have read and understood these rules and to be bound by them and by any other requirements set out in any related promotional material. Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction. In the event of playing a Competition online, by accepting these terms and conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our Competitions. The Promoter will not be held responsible for any entrant entering any of our Competitions unlawfully. If in any doubt you should immediately leave the website and check with the relevant authorities in your country.
- Competition Entry: Competitions may be entered using a 7able representative or online. Availability and pricing of Competitions is at the discretion of the Promoter:
a) To enter a Competition from a representative, you will need to purchase Competition entries ('Tickets') through a member of staff at a location approved by the Promoter. Using all the information shown in the sporting photograph displayed on the computer screen (from which the original ball has been permanently erased), use your skill and Judgement to correctly identify the grid square within which you consider the Judge will decide, is the most likely position of the centre of the ball. Click on the screen to mark this spot (you can see your spot's coordinates on the screen). The computer will register this spot as your entry into the Competition. You may repeat this process for as many entries as you wish to make. Then you will provide the representative with your own, correct, name, full contact details and the appropriate payment. You will be given a receipt with your personal details and Ticket entries. You will need to check your details carefully and sign the declaration, confirming you have read and understood the Competition rules.
b) When playing a Competition online, follow the on-screen instructions and play the Competition as outlined in (3a). When you are ready to purchase your Ticket(s), follow the on-screen instructions to provide your contact details and your payment details. You will need to check your details carefully and tick the declaration, confirming you have read and understood the Competition rules. When your payment has cleared we will then contact you by email to confirm your entry into the Competition (in the case of Instant Win Competitions, we will also provide you with instantaneous feedback). Please note that when entering online you will not be deemed entered into the Competition until we confirm your Ticket order back to you by email.
- Gift Vouchers: To pay for your Ticket(s) using a Gift Voucher, please follow the playing instructions outlined in (3b). To make payment, enter the code supplied on your Gift Voucher at the checkout stage. Your entry into the Competition will be confirmed when the Gift Voucher code is authorised. Please note that Competition entries can only be purchased up to and including the value of the Gift Voucher. No refund for the Gift Voucher will be provided by the Promoter. If you wish to purchase Tickets that have a greater value than that of the Gift Voucher, it is possible to pay for the remainder via our payment methods. Please note, if you are using a Gift Voucher as payment when playing the Competition online, you will not be deemed entered into the Competition until we confirm your Ticket order back to you by email.
- Duplicate accounts: You may only open one account with us in relation to the Website. Any other accounts which You open with us in relation to the Website shall be “ Duplicate Accounts”. Any Duplicate Accounts may be closed by us immediately and: all transactions made from the Duplicate Account will be made void; all deposits made using that Duplicate Account will be returned to You; and any returns, winnings or bonuses which You have gained or accrued during such time as the Duplicate Account was active will be forfeited by You and may be reclaimed by us.
- Game Credit & Loyalty Points: Game credit can only be used against the cost of Superprize competitions entries, if game credit is not used within the month of its arrival then it will be forfeited. Loyalty points can be exchanged for game credit or can be used against the purchase of physical/virtual items within the promoters online shop.
- Deposits & Bonuses: The promoter offers users bonuses for depositing lump sums of monies into their 7able account. These bonuses can comprise of Game Credit, Loyalty points, physical or virtual prizes and cannot be exchanged for anything else.
- Cashback: Users can complete offers or purchase goods via the 7able cashback section in return they will be given ‘Game Credit’, in the form of a percentage of the total paid for goods or a fixed amount per offer. ‘Game Credit’ from cashback can take up to 1 day to appear in a users account and up to 60 days for it to be confirmed.
- Challenges: To compete in a 7able challenge users must login to their ‘My account’ section, select 7able challenges and follow the on-screen steps. Once a challenge has been completed the promoter needs to validate the completion, once approved you will receive an email stating the amount of game credit received.
- Competition Judgement
a) Time Limited Competitions:
Time Limited Competitions: Time Limited Competitions will close on the date specified. The position of the centre of the ball will be determined by an
independent Judge (a sporting expert appointed by the Promoter – the 'Judge') using his sporting experience and in the presence of a qualified lawyer
and a representative from the Promoter. The Judge's chosen position will then be computed against the database of coordinates to mathematically
calculate which of the Competition entrants is closest to the Judge's position, and therefore the winning entrant (the 'Winner') of the prize. The
Winner will be the person who correctly identifies, or if no one is correct, who is closest to, the grid square within which the centre of the ball is
judged to be located.
In the event that one or more entrants are equally close to or exactly match the Judges' coordinates (a 'Tie') when a Time Limited Superprize
Competition (Competition reference prefixed with 'SC') is judged, these entrants (the 'Superprize Competition Tie Entrants') will be asked to take part
in another “spot the ball” Competition in order to determine a single Winner. The Tie entry mechanism (the 'Superprize Competition Tie Break') will be
exactly the same as before but with a new sporting photograph and there will be no payment due. The Competition will be judged in exactly the same way
to determine the Winner. In the very unlikely event there is another Tie, the Superprize Competition Tie Break process will be repeated until there is
a single Winner. The Cash Alternative (see below 7a) for the Competition will be split between the Superprize Competition Tie Entrants. The Winner of
the Superprize Competition Tie Break will receive £5,000. The Superprize Competition Tie Entrant(s) involved in the Superprize Competition Tie Break
who do not win will share the remaining £4,000 which will be split equally between the number of runners up.
In the event of a Tie for any other Time Limited Competition, the Joint Winners will share equally the specified Cash Alternative.
The Promoter reserves the right to cancel any Time Limited Competition, for any reason, before the designated closing date. In these circumstances the
Promoter reserves the right to transfer the entrants' Ticket(s) into another Competition for which the ticket price is at least the same or more than
the original price paid. The Promoter also reserves the right at its sole discretion to extend the closing date on any Time Limited Competition.
b) Ticket Limited Competitions:
Ticket Limited Competitions will close when the specified number of Tickets have been sold. The position of the centre of the ball will be determined
by an independent Judge, using his sporting experience in the presence of a qualified lawyer and a representative from the Promoter. The Judge's chosen
position will then be computed against the database of coordinates to mathematically calculate which of the Competition entrants is closest to the
Judge's position, and therefore the Winner of the prize. The Winner will be the person who correctly identifies, or if no one is correct, who is
closest to, the grid square within which the centre of the ball is judged to be located. In the event of a Tie, the winning entrants ('Joint Winners')
will share equally the specified Cash Alternative.
The Promoter reserves the right to close any Ticket Limited Competition prior to all of the tickets being sold. In this situation the Promoter at its
sole discretion will either; award the full prize in the normal way, or, calculate the total number of tickets sold as a percentage of the total number
specified for that Competition, with the prize forming the same percentage of the cash alternative. By way of example if only 70/100 or 70% of the
tickets had been sold when the Competition closed and the cash alternative for the Competition prize was £1000, the new prize would become £700 and the
judging would continue as normal.
c) Instant Win Competitions:
Instant Win Competitions will close immediately when an entrant matches the Judges' coordinates or, if no one matches the Judges' coordinates, on the
specified end date (‘Drop Dead Date’). The position of the centre of the ball will be determined before the Competition starts by an independent Judge,
using his sporting experience in the presence of a qualified lawyer and a representative from the Promoter, and will immediately be encrypted and
stored securely on our database. Each Competition entry will be computed against the Judge's coordinates. If the coordinates match, the Winner is
selected instantaneously and the Competition closes.
If no one has exactly matched the chosen coordinates prior to the specified Competition Drop Dead Date then either a prize of a specified amount of
Game Credit will be awarded or the actual prize (please refer to the individual competition details). The Judges's chosen position will be
computed against the database of all the entrants coordinates to mathematically calculate which of the competitors is closest to the judge's position,
and therefore the Winner of the Game Credit. In the event of a Tie, the winning entrants ('Joint Winners') will share equally the specified Game
Credit.
All pre-purchased Instant Win Credits must be played prior to the closing of the relevant competition. For the avoidance of doubt, if an Instant Win
Competition closes and there is un-played Instant Win Credit in your account for that competition, it will be forfeited.
d) Free Competitions: Free Competitions will close on the date specified. The position of the centre of the ball will be determined by a director from the Promoter. The chosen position will then be computed against the database of coordinates to mathematically calculate which of the Competition entrants is closest to this position, and therefore the winning entrant (the 'Winner') of the prize. The Winner will be the person who correctly identifies, or if no one is correct, who is closest to, the grid square within which the centre of the ball is judged to be located. In the event of a Tie, the winning entrants ('Joint Winners') will share equally the specified Cash Alternative.
The Winner of a Competition will be notified at the address or telephone number given in their contact details within 20 days of the closing date of
the relevant Competition. Any entrant may check the results of Competitions completed within the last 12 months at our website www.7able.com. All
decisions of the Judge will be final and binding on the entrants and no correspondence will be entered into.
All Competition entrants are automatically entered onto the Promoter's database for the purpose of conveying information as to the status of their
Competition, as well as for any future promotions or Competitions offered by the Promoter.
- Winner's Details: The Winner will be required to send a copy of their passport to the Promoter to confirm their identity, age and also to prove that if the purchase was made by credit card that the card was legally theirs or that they had authorisation to use it, before any prize will be paid or delivered. The Winner will also be required to provide photographs for use in future marketing by the Promoter. Following receipt and verification of the details requested above by the Promoter, the Winner will be contacted in order to make arrangements for delivery of the prize. At this point the Winner must choose between the prizes available (as detailed in the Competition prize information on the Promoters' website www.7able.com) and notify the promoter of their choice in writing.
- Competition Prizes:
- a) Time Limited Superprize Competitions: The Winner of a Time Limited Superprize Competition (a Competition reference prefixed with 'SP') will be able to choose one prize from the list of prizes detailed on the website or via a 7able representative relating to that Competition. Please also note the following:
- (i) During the course of a Time Limited Superprize Competition the Promoter reserves the right to add or remove prizes from the Competition.
- (ii) If the Winner would like a prize the Promoter does not already own, an order will be placed by the Promoter. Delivery for prizes not owned by the promoter may take up to 12 months for certain prizes and prizes will be ordered in basic specification. All prizes will be ordered in the UK from UK dealers only. Bespoke options and upgrades can be added at the prize Winners' request but must be paid for in advance. For car prizes the winner can choose the car in Left or Right Hand Drive (subject to manufacturer availability and terms and conditions).
- (iii) In the UK the prize will be delivered with UK VAT paid. In the EU the prize will be delivered with UK VAT paid but any further costs (VAT/taxes/import duties/registration costs due in the destination/country of final registration) will be the responsibility of the prize Winner.
- (iv) In all other countries the prize will be shipped (net of all taxes) to the nearest port and any applicable import duties/taxes/registration costs due in the destination country will be the responsibility of the prize Winner. The promoter reserves the right not to deliver to certain countries. Please note that all our prizes are supplied in the UK and therefore if exported may not be legal in the destination country. It is the winner’s responsibility to check this and choose an alternative prize or take the cash alternative if appropriate.
- (v) Superprize Competition Cash Alternative: Should a Superprize Competition (prefixed ‘SP’) Winner not wish to take delivery of one of the prizes detailed, the Superprize Competition Cash Alternative of £9,000 can be claimed.
- (vi) Runners Up Prizes: Runners Up Prizes will be awarded for Superprize Competitions only, in the following manner. The ten entrants closest to the Judge's position with the exception of the Winner, will each receive a days pampering for two, Supercar driving experience for one or paintballing for 10. Pampering days & Supercar Experience days are supplied by Red Letter Days Limited, United Kingdom. Paintballing for 10 is supplied by Delta Force Paintball, United Kingdom and includes a full day of paintball action but excludes paintballs. All runner-up prizes must be redeemed within six months of the closing date of the Competition and are subject to availability. Separate terms and conditions relating to the acceptance of these prizes must be agreed to and are available on request. The subsequent 10 entrants closest to the Judge's position will each receive £50 worth (face value) of Superprize Competition tickets for Competitions run by the promoter. These may not be used in conjunction with any further offers and must be redeemed within 6 months.

b) Other Time Limited Competitions, Ticket Limited Competitions and Instant Win Competitions:
The Winner of a non-superprize Time Limited Competition will be able to choose (if applicable) one of the prizes or the Cash Alternative as
specified and detailed on the Promoter's website www.7able.com, relating to that Competition.
In the European Union and the UK the prize will be delivered with UK VAT paid but any other taxes/import duties/registration costs due will be the responsibility of the prize Winner. In all other countries the prize will be shipped (net of all taxes) and any applicable import duties/taxes/registration costs due in the destination country will be the responsibility of the prize Winner. The promoter reserves the right not to deliver to certain countries.
By using the promoters website you agree that you shall not participate in or be connected with any form of collusion, cheating or fraudulent practice, or otherwise any other criminal activity, in connection with your access to or use of the Website. Any breach of this paragraph by you will be a material breach of the Terms of Use.
If we have reasonable grounds to believe that:
· You have participated in or have been connected with any form of collusion, cheating, unfair or fraudulent practice, or otherwise any other criminal activity; or
· You have, in relation to any game played, gained an unfair advantage over us or any other person participating in the relevant game; or
· a game in which You participated included the use of collusive or fraudulent practice, or any cheating; or
· we become aware that You have played online games with any other online provider of skill based games and are suspected (as a result of such play) of collusion, cheating or fraud (including in relation to charge-backs), or otherwise any criminal or otherwise improper activity; or
· we become aware that You have "charged back" or denied any of the purchases or deposits that You made to Your Account; or
· You become bankrupt or suffered analogous proceedings anywhere in the world,
then we shall have the right to suspend Your Account for an indefinite period of time.
The basis of our belief shall include the use by us (and by our skill based partners and our other suppliers) of any fraud, cheating and collusion
detection practices which are used in the skill based gaming industry at the relevant time.
a “fraudulent practice” shall include the use by You or any other person who was participating in the same game as You at any time, of a stolen,
cloned or otherwise unauthorised credit or debit card, as a source of funds;
a “criminal activity” shall include money laundering; and
an “unfair advantage” shall include: the exploitation of a fault, loophole or error in our software (including a game); the use of automated
players (sometimes known as ‘bots’); or the exploitation by You of an ‘Error’ as defined in paragraph 18.
If we believe cheating, fraud or criminal activities are taking place we will thoroughly investigate the grounds for our belief (which may be after we
have initially suspended Your Account or withheld the balance of Your Account, as the case may be) in accordance with our usual practices and to our
satisfaction, and that we shall complete such investigations in a timely manner. We undertake that we will use all reasonable endeavours to ensure
that, while complying with our regulatory and other legal obligations, we exercise our rights in this paragraph in a manner, which is fair to You and
to our other customers.
We reserve the right to inform relevant authorities, other online skill based operators, other online service providers and banks, credit card companies, electronic payment providers or other financial institutions of Your identity and of any suspected unlawful, fraudulent or improper activity, and You agree to cooperate fully with us to investigate any such activity.
- Winners' Personal Data: Acceptance of the prize by the Winner gives the Promoter the right to use the prize-Winner's name, personal photograph and home country for promotional purposes, both immediately after their win and in the future, unless prohibited by law.
- Limits of Liability: The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize Winner and, where applicable, to any family/persons accompanying the Winner, or in connection with any of the Competitions promoted by the Promoter.

Electronic Communications:
No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic
or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet,
accessibility or availability or for traffic congestion or unauthorised human act.
The Promoter shall use its best endeavours to award the prize for a competition to the correct entrant. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, the Promoter reserves the right to reclaim the Competition prize and award it to the correct entrant, at its sole discretion and without admission of liability. The Promoter shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due. -
Errors
A number of circumstances may arise when a ticket is accepted, or we accept a payment, in error. A non-exhaustive list of such circumstances is as follows:
· Where we mis-state any terms to You as a result of obvious error or omission in inputting the information, or as a result of a computer malfunction;
· Where we have continued to accept tickets on a competition which should have been suspended or closed, including where the relevant event is in progress or had already finished;
· where an error is made by us as to the amount of loyalty points or game credit that is paid to You, including as a result of a manual or computer input error.
· any such circumstances will be referred to as an “Error”.
We reserve the right to correct any Error made on a ticket purchased and re-settle the same at the correct terms which were available or should have
been available through the Operator (absent the publishing error) at the time that the ticket was placed and the ticket will be deemed to have taken
place on the terms which were usual for that ticket purchase.
Any amounts that have been credited to your Account, or paid to you as a result of an Error shall be deemed to be held by You on trust for us and shall
be immediately repaid to us when a demand for payment is made by us to You. Where such circumstances exist, If You have amounts in Your Account we may
reclaim these amounts from Your Account pursuant to paragraph 7.4. We agree that we shall use all reasonable endeavours to detect any Errors and inform
You of them as soon as reasonably practicable.
Neither we (including our employees or agents) nor our partners or suppliers shall be liable for any loss including loss of winnings that results from
any Error by us or an error by You. You will forfeit any winnings/losses that result from any such Error.
Where You have used monies which have been credited to Your Account or awarded to You as a result of an Error to place subsequent tickets or play
games, we may cancel such tickets and/or withhold any winnings which You may have won with such monies.

Data Protection Notice:
Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will
be used by the Promoter (i) to administer the Competition; and (ii) (unless you tell us that you prefer not to receive direct marketing) to contact
you about other Competitions or about other goods and services which the Promoter considers may be of interest to you.
In order to process, record and use your personal data the Promoter may disclose it to (i) any credit card company whose name you give; (ii) any organisation (whether or not connected to the Promoter) for the purpose of bringing to your attention goods and services which the Promoter considers may be of interest to you; (iii) any person to whom the Promoter proposes to transfer any of the Promoter's rights and/or responsibilities under any agreement the Promoter may have with you; (iv) any person to whom the Promoter proposes to transfer its business or any part of it; (v) comply with any legal or regulatory requirement of the Promoter in any country; and (vi) prevent, detect or prosecute fraud and other crime.
